§ 1 Delivery and services
All deliveries and services based on online orders via the Internet are subject to these General Terms and Conditions. Deviating and / or supplementary agreements require the express consent of Atelier-dp as well as the written form. A legally valid purchase contract is concluded by the customer's order received by us and our acceptance (e.B. by telephone, e-mail or by conclusive action). When ordering software downloads, the download link is immediately available to you when paying by PayPal. When paying in advance, the download will only be activated upon receipt of payment.

§ 2 Online Orders
Atelier-dp will process and ship incoming online orders immediately. Delivery dates are non-binding, unless they have been agreed in writing.

3. Contract language, contract text storage

3.1. The contract language is german.

3.2. The complete text of the contract will not be stored by us. Before sending the order, the contract data can be printed out or electronically saved via the print function of the browser. After receipt of the order by us, the order data, the legally prescribed information for distance contracts and the General Terms and Conditions will be sent to you again by e-mail.

§ 4 Invoice and payments
Invoices are due immediately and payable without any deductions, unless deviating payment methods have been agreed. Outstanding invoices are due for payment within 14 days. From the 30th day after the invoice date, Atelier-dp is entitled to demand default interest at the rate of 3% above the respective discount rate of the Deutsche Bundesbank.


§ 5 Object of purchase and ownership
The object of purchase remains the property of Atelier-dp until full payment has been made. The retention of title shall also remain valid for all claims against the buyer in connection with the object of purchase, e.B. subsequently acquired due to repairs and other services. During the duration of the retention of title, the buyer is entitled to possess and use the object of purchase in accordance with the contract, as long as he fulfils his obligations arising from the retention of title and his obligations from the business relationship in due time. The customer is obliged to provide the operator with all information required in the context of a rights prosecution arising from the agreed retention of title.

§ 6 Non-acceptance of the goods
Ordered and not accepted goods, or unredeemed direct debits entitle Atelier-dp to terminate the contract as well as to justify a claim for damages in the amount of 20% of the net order value and processing costs in the amount of 10.00 EURO plus VAT. A claim for damages shall also apply if the customer does not withdraw from the purchase contract in writing within the statutory withdrawal period. A purchase contract is concluded when the online order is sent. The customer accepts the GTC order conditions by sending the order.

§ 7 Electronic data storage
Atelier-dp is entitled to collect, store and process the personal data of the customer required in the context of the business relationship. The transfer to third parties of personal data will not be carried out.

§ 8. Data protection information
8.1 After conclusion of the contract, DaWanda shall transmit to the Provider the DaWanda user name, the name and the billing address as stored in the Customer's user account. Insofar as the customer has provided further data in the context of his order (e.B. a different delivery address or a telephone number), these will also be transmitted.

8.2 The Provider processes the data referred to in paragraph 1 electronically for the proper fulfilment of the contract, in particular for dispatch, invoicing and the booking of payments. For the purpose of shipping, the provider may also transmit the name and address of the customer to the commissioned shipping company.

8.3 The provider shall keep the data stored until all mutual claims arising from the order have been completely settled and the commercial and tax retention obligations for the provider have expired.

8.4 The Purchaser may at any time request information from the Provider about the data he has stored about the Purchaser. Furthermore, the customer may request the correction of incorrect data at any time.

8.6 Insofar as the customer uses the service of PayPal for payment, the PayPal data protection regulations apply to the payment process. PayPal acts as a vicarious agent of the customer, not of the provider.

§ 9 Right of return/right of withdrawal

You have the right to revoke this contract within fourteen days without giving reasons.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods. To exercise your right of withdrawal, you must inform us:

by means of a clear declaration (e.B. a letter sent by post, fax or e-mail) about your decision to revoke this contract. You can use the attached model withdrawal form, but this is not mandatory.
You can also electronically complete and submit the model withdrawal form or any other unambiguous declaration on our website www.Dawanda.de/shop/cellini. If you make use of this option, we will immediately (e.B. by e-mail) send you a confirmation of receipt of such a revocation. To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.
Consequences of revocation:
If you withdraw from this contract, we shall reimburse you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods immediately and in any case at the latest within fourteen days from the day on which you inform us of the revocation of this contract to: Dominic Pieper, Grabenstr. 1, 58511 Lüdenscheid. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the direct costs of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check the nature, characteristics and functioning of the goods.

In Annex 2 to Article 246a § 1 paragraph 2 sentence 1 number 1 and § 2 paragraph 2 number 2 EGBGB, the legislator provides the following model revocation form:

Delivery

Our experience shows that your order will be with you within a few days or a week (max.!!). For special productions, the delivery time can take up to 14 days.
