For the out-of-court settlement of consumer disputes, the European Union has launched an online platform ("OS platform"): http://ec.europa.eu/consumers/odr/
Terms of Service
The deliveries, services and offers are made in accordance with the Etsy General Terms and Conditions and our General Terms and Conditions in their version valid at the time of the order. Individual contract agreements have priority over general terms and conditions.
1. Conclusion of the contract / purchase
(1) Conclusion of the purchase contract
The posting of the article description by us at Etsy constitutes an offer to conclude the contract. In order to accept such an offer, the customer must carry out the following technical steps:
He puts the article in the shopping cart. After that he clicks on the button "Checkout". This opens an overview with article description, price, packaging and shipping costs and payment methods. Here the customer can check whether goods and contract conditions are accepted by him. If this is not the case, the customer can close the window, otherwise he can make corrections via the "Back" button. If the offer meets its expectations, the customer can confirm his order by clicking on the button "Order for payment" and conclude the purchase contract.
(2) After concluding the contract, you will automatically receive an email with further information on the execution of the contract.
(3) Further information on electronic commerce can be found in clause 5 of the GTC.
(4) In addition, we refer to the terms of the contract and the individual technical steps on the Etsy Terms and Conditions, which you can find at the end of each Etsy page.
2. Choice of law
The law of the Federal Republic of Germany applies to the contractual relations between the contracting parties. Excluded from this choice of law are the mandatory consumer protection regulations of the country in which the customer has his habitual residence. The application of the UN Sales Convention (CSIG) is excluded.
3. Prices / shipping costs
(1) The remuneration includes the value added tax (value added tax) valid at the time of the order.
(2) In the case of deliveries to countries outside the European Union, additional costs may be incurred in individual cases, which the seller is not responsible for and which must be borne by the customer. These include, for example, costs of transferring money by credit institutions (for example, transfer fees, exchange rate charges) or import duties or taxes (for example, customs duties). Such costs may be incurred in relation to the transfer of funds even if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.
(3) The customer has various payment options available, which are specified in the seller's offer at Etsy.
(4) When paying by means of a payment method offered by PayPal, payment is handled by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to as "PayPal"), under the terms and conditions of PayPal.
(5) For payments by "Etsy coupon" the coupon conditions of Etsy apply.
(6) Pickup is not possible.
4. Distance-related information / link to the OS platform
(1) The description of the goods follows from the presentation on the Etsy platform.
(2) The instructions on your statutory right of withdrawal as a consumer, exceptions to the right of withdrawal, its premature extinction, the cancellation form, the consequences of withdrawal, eg. B. Return, return costs and value replacement, can be found in the detailed Etsy offer in the recess for the right of withdrawal.
(3) Delivery will be made within 5 working days (Monday to Friday, excluding public holidays) after the payment order has been issued to the transferring bank (in advance) or after conclusion of the contract (cash on delivery or purchase of invoice).
(4) There is no out-of-court complaint or appeals procedure to which we are subject.
(5) Since 9 January 2016, Regulation (EU) No 524/2013 (ODR Regulation) has entered into force on the online dispute resolution in consumer affairs. It applies to the out-of-court dispute resolution of disputes over contractual obligations arising from online sales contracts or online service contracts between consumers and online retailers and aims at achieving a high level of consumer protection in the European internal market. The possibility of online dispute resolution (OS) should provide a simple, efficient, fast and cost-effective out-of-court solution to disputes. The OS platform forwards properly filed complaints to the AS (Out-of-Court Dispute Settlement) bodies (under national law). The use of the OS platform itself is free; in cases before the ADR entities, the consumer may incur costs (up to EUR 30.00) if his application is abusive.

5. Information about electronic commerce
1. Technical steps to conclude the contract

2. Contractual Text / Expression
You can save the text of the contract yourself by using the function of your "Save as" browser to save the relevant website on your computer. The print function of your browser also gives you the option of printing the contract text.
We ourselves save as a seller after signing the contract and make it available to our customers on request.
3. Correction possibility
You can correct your entries at any time during the ordering process by selecting the "Back" button in the browser and then making the appropriate change. By closing the web browser, you can cancel the entire ordering process at any time.
4th language
The language available for the conclusion of the contract is exclusively German.
5. Code of Conduct
In addition to the conditions of participation of the platform operator Etsy, we have not subjected ourselves to any special code of conduct (rules and regulations).
6. Warranty
There is a statutory right of defect for goods. The warranty for defects of the goods is 24 months for new goods according to the statutory provisions.
For used goods, the warranty period is 12 months. The warranty period begins from the delivery of the goods to the buyer.
However, it remains with the regular limitation period of 3 years,
beginning with the end of the year in which
1. the claim has arisen and
2. the creditor should have knowledge of the circumstances giving rise to the claim and of the person of the debtor, or would have to acquire them without gross negligence,
- when it comes to liability for damages resulting from injury to life, limb or health, which are based on a negligent or intentional breach of duty or a willful or negligent breach of duty of one of my vicarious agents
- if it concerns the liability for other damages, which are based on an intentional or grossly negligent breach of duty committed by me or on an intentional or grossly negligent breach of duty of one of my vicarious agents or
- in the case of liability for fraudulently concealed defects, claims arising from promises of guarantee or liability in accordance with mandatory statutory provisions, eg. B. according to the product liability law.
The two-year limitation period for recourse claims in accordance with §§ 478, 479 BGB remains unaffected.
The warranty does not cover normal wear or normal wear.
7. Retention of title
1.We reserve ownership of the delivered item until receipt of all payments under the purchase contract. If the buyer does not fulfill his contractual obligations, in particular in case of late payment, we are entitled to demand the delivered item; the buyer is obliged in this case to return the object.
2. The buyer is obliged to notify us immediately in the event of seizure of the object of purchase or other relevant access or attempted access by third parties with respect to the object of purchase so that we can exercise our rights arising from the reservation of title.
8. Privacy Policy
All personal customer data collected and stored by us are used exclusively for the purpose of the purchase. The name and surname of the customer, the corresponding invoice and delivery address as well as a possibly stored phone number and email address are stored. The data collected will not be passed on to other third parties, with the exception of legally necessary measures (eg collection agency, lawyer, credit bureaus) and measures of transporting the goods, including the tracking of consignments.

9. Copyright
The photos and the texts created by us are protected by copyright. The copying and publishing thereof (even in part) is gem. § 97 UrhG prosecuted under civil and criminal law.
10. Note on Battery Law (BattG)
If the offer includes batteries or batteries, you are legally obliged to dispose of used batteries or rechargeable batteries separately. Please hand it in at a municipal collection point or at the local retailer. You can return batteries and rechargeable batteries that you have received from us free of charge. Batteries that contain pollutants are marked with the crossed-out wheelie bin symbol and the chemical symbol of the pollutant (for example, "Cd" for cadmium, "Pb" for lead, "Hg" for mercury). You will also find these instructions in the accompanying documents of the consignment.
11. Transport damage
(1) If goods are delivered with obvious damage in transit, so please complain such errors immediately to the deliverer and please contact us as soon as possible.
(2) The failure to make a complaint or contact has no consequences for your statutory warranty claims. However, they help us assert our own claims against the carrier or the transport insurer.
12. Severability clause
Should individual provisions of the contract with the customer, including these GTC, be or become invalid in whole or in part, or should the agreements contain a gap, this shall not affect the validity of the remaining provisions.
