Teil I - Allgemeine Geschäftsbedingungen
§ 1 – Anbieter, Einbeziehung der AGB
(1) Anbieter und Vertragspartner für die im Etsy-Shop „wiesengruenS“ dargestellten Waren ist Gaby Lehnert, Speckfeld 23, 33824 Werther, Telefon 05203 2941928, E-Mail gabylehnert@web.de (im Folgenden kurz „Anbieter“).
(2) Der Anbieter handelt als Unternehmer.
(3) Diese allgemeinen Geschäftsbedingungen sind Bestandteil jeder vertraglichen Vereinbarung zwischen dem Anbieter und dem jeweiligen Besteller. Entgegenstehenden AGB des Bestellers wird widersprochen.
§ 2 – Warenangebot und Vertragsschluss
(1) Der Anbieter bietet die in seinem Etsy-Shop „wiesengruenS“ dargestellten Waren zum Kauf an. Die farbliche Darstellung der Waren auf der Internetseite kann je nach verwendetem Internetbrowser und Monitoreinstellungen des Bestellers geringfügig variieren; diese Abweichungen sind technisch nie ganz vermeidbar.
(2) Warenauswahl, Vertragsschluss und Vertragsabwicklung erfolgen in deutscher Sprache.
(3) Der Besteller wählt die gewünschte Ware aus, indem er sie in den „Warenkorb“ legt. Sind dort alle gewünschten Waren enthalten, bestätigt der Besteller dies mit dem Button „Zur Kasse gehen“. Die Seite mit der Überschrift „Bitte bestätige deine Bestellung“ zeigt dem Besteller eine Zusammenfassung aller seiner Eingaben. Der Bestellwunsch kann auf dieser Seite über den Button „Zahlungspflichtig bestellen“ an den Anbieter übermittelt werden. Der Besteller hat bis zu dieser Absendung seines Bestellwunsches jederzeit die Möglichkeit, seine Eingaben zu korrigieren, indem er einen oder mehrere Bestellschritte im Browser zurückgeht, oder die Bestellung ganz abzubrechen.
(4) Für die in seinem Shop dargestellten Waren gibt der Anbieter ein verbindliches Kaufangebot ab. Mit der Absendung des Bestellwunsches über den Button „Zahlungspflichtig bestellen“ nimmt der Besteller das Kaufangebot an. Der Anbieter bestätigt den Vertragsschluss per E-Mail (Vertragsbestätigung).
(5) Den Inhalt eines abgeschlossenen Vertrags (Vertragstext) speichert Etsy im Etsy-Nutzerkonto des Anbieters, zu dem der Besteller jedoch keinen Zugang hat. Sofern der Besteller nicht als Gast bestellt, sondern sich vor Abschluss der Bestellung in sein Etsy-Nutzerkonto eingeloggt hat, speichert Etsy den Inhalt des abgeschlossenen Vertrags auch im Etsy-Nutzerkonto des Bestellers, abrufbar im Bereich „Einkäufe und Bewertungen“ im Menü „Du“. In jedem Fall erhält der Besteller von Etsy eine E-Mail mit dem Vertragstext. Darüber hinaus speichert der Anbieter den Vertragstext nicht selbst und macht ihn außerhalb des Etsy-Portals auch nicht zugänglich.
(6) Bei Lieferhindernissen oder anderen Umständen, die der Vertragserfüllung entgegenstehen würden, informiert der Anbieter den Besteller per E-Mail.
§ 3 – Preise, Bezahlung und Lieferung
(1) Alle Warenpreise verstehen sich als Gesamtpreise zzgl. Versandkosten. Umsatzsteuer wird nicht ausgewiesen (§ 19 UStG).
(2) Die Versandkosten sind bei der jeweiligen Warenbeschreibung im Abschnitt „Versand & Rückgaben“ aufgeführt.
(3) Der Besteller kann per Kreditkarte zahlen (VISA, MasterCard, American Express). Im Warenkorb können daneben weitere Bezahlmethoden zur Verfügung stehen, z.B. PayPal oder Klarna („Sofort.“).
(4) Zahlungen des Bestellers können im Auftrag des Anbieters von Etsy Ireland UC oder von Etsy Payments Ireland Limited, beide ansässig 66/67 Great Strand Street, Dublin 1, Irland, bzw., bei Zahlung in US-Dollar oder Kanadischen Dollar, von Etsy Inc., 117 Adams Street, Brooklyn, NY, USA, (im Folgenden kurz „Etsy“) entgegengenommen werden. Etsy leitet in diesem Fall den gezahlten Betrag an den Anbieter weiter.
(5) Der Anbieter behält sich das Eigentum an der gelieferten Ware vor, bis der Besteller deren Kaufpreis vollständig bezahlt hat.
(6) Wenn eine Lieferung fehlschlägt, weil der Besteller die Lieferadresse falsch oder unvollständig angegeben hat, erfolgt ein erneuter Zustellversuch nur, wenn der Besteller die unmittelbaren Kosten des erneuten Versands übernimmt.
(7) Bei Lieferungen in Länder außerhalb der Europäischen Union können Zoll und Einfuhrumsatzsteuer anfallen, die vom Besteller beim Empfang der Sendung an die Zollbehörde zu entrichten sind. Diese Abgaben fallen zusätzlich zu Kaufpreis und Versandkosten an und sind vom Anbieter nicht zu beeinflussen.
§ 4 – Widerrufsrecht
(1) Einem Besteller, der als Verbraucher kauft, steht ein Widerrufsrecht gemäß den gesetzlichen Bedingungen zu.
(2) Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
(3) Einem Verbraucher mit ständigem Aufenthalt außerhalb Deutschlands räumt der Anbieter ein Widerrufsrecht gemäß den obigen Absätzen auch dann ein, wenn das nationale Recht des Verbrauchers kein Widerrufsrecht vorsieht oder den Widerruf an eine kürzere Frist oder an eine strengere Form knüpft als hier geregelt.
§ 5 – Gewährleistung (Mängelhaftung)
(1) Es bestehen Gewährleistungsansprüche des Bestellers (auch Mängelhaftungsrechte genannt) gemäß den gesetzlichen Vorschriften, soweit sich aus den folgenden Absätzen nichts anderes ergibt.
(2) Ist der Besteller Verbraucher, so kann die Verjährungsfrist für Gewährleistungsansprüche für die angebotenen Gebrauchtwaren auf ein Jahr verkürzt sein, wenn und soweit der Verbraucher vor der Abgabe seiner Vertragserklärung von der Verkürzung der Verjährungsfrist eigens in Kenntnis gesetzt wurde und die Verkürzung der Verjährungsfrist im Vertrag ausdrücklich und gesondert vereinbart wurde.
(3) Ist der Besteller kein Verbraucher, so vereinbaren die Parteien hiermit für die angebotenen Gebrauchtwaren eine auf ein Jahr verkürzte Verjährungsfrist für Gewährleistungsansprüche.
(4) Eine verkürzte Verjährungsfrist gilt jedoch in keinem Falle für Ansprüche aufgrund einer Verletzung des Lebens, des Körpers oder der Gesundheit und auch nicht für Ansprüche wegen sonstiger Schäden, die auf einer grob fahrlässigen oder vorsätzlichen Pflichtverletzung des Anbieters, seiner gesetzlichen Vertreter oder seiner Erfüllungsgehilfen beruhen.
§ 6 – Außergerichtliche Streitbeilegung
(1) Zur außergerichtlichen Beilegung von verbraucherrechtlichen Streitigkeiten stellt die Europäische Union eine Online-Plattform („OS-Plattform”) zur Verfügung unter der Adresse ec.europa.eu/consumers/odr.
(2) Wir sind weder verpflichtet noch bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
§ 7 – Schlussbestimmungen
(1) Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Gegenüber Verbrauchern mit ständigem Aufenthalt im Ausland findet das deutsche Recht jedoch keine Anwendung, soweit das nationale Recht des Verbrauchers Regelungen enthält, von denen zu Lasten des Verbrauchers nicht durch Vertrag abgewichen werden kann.
(2) Sollten sich einzelne Bestimmungen dieser allgemeinen Geschäftsbedingungen als unwirksam oder undurchführbar erweisen, so berührt dies nicht die Wirksamkeit der übrigen Bestimmungen.

Teil II: Informationen zum Verbraucher-Widerrufsrecht
Widerrufsbelehrung für postalisch gelieferte Waren
Widerrufsrecht
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat.
Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Gaby Lehnert, Speckfeld 23, 33824 Werther, Telefon 05203 2941928, E-Mail gabylehnert@web.de) mittels einer eindeutigen Erklärung (z.B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.
Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an uns zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden.
Sie tragen die unmittelbaren Kosten der Rücksendung der Waren.
Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.
Ausnahmen vom Widerrufsrecht
Das Widerrufsrecht besteht nicht bei Verträgen über die Lieferung von Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind.

Part I - General Terms and Conditions
Section 1 – Vendor, inclusion by reference of the General Terms and Conditions
(1) The Vendor and contracting party for the goods presented in the Etsy Shop „wiesengruenS“ is Gaby Lehnert, Speckfeld 23, 33824 Werther, phone 05203 2941928, e-mail gabylehnert@web.de (referred to hereinbelow as the “Vendor” for short).
(2) The Vendor acts as a merchant.
(3) The present General Terms and Conditions are a component part of any contractual agreement made between the Vendor and the respective Customer. The Vendor hereby objects to any terms and conditions that the Customer may have established and that contradict the present General Terms and Conditions.
Section 2 – Goods offered and conclusion of contract
(1) The Vendor is offering the goods presented in the Etsy Shop “wiesengruenS” for sale to other Etsy users. The colors of the goods shown on the website may vary slightly depending on the internet browser and monitor settings used by the Customer; these variations are technically unavoidable.
(2) Selection of goods, conclusion of contract and implementation of the agreement shall all take place in German.
(3) The Customer shall select the goods desired by placing it in his “Cart” (“Warenkorb”). When the cart contains all goods desired, the Customer proceeds to the checkout by clicking on “Proceed to Checkout” (“Zur Kasse gehen”). The page titled “Please confirm and submit your order” shall display a summary, so that the Customer can check for any incorrect input. On this page, the Customer can place his order with the Vendor by clicking on the button “Buy” (“Zahlungspflichtig bestellen”). Until the order is transmitted to the Vendor, the Customer may go back one or multiple steps in the browser to modify the data input or to completely discontinue the order.
(4) The Vendor is making a binding sales offer for the goods presented in his shop. By transmitting the order using the button “Buy” (“Zahlungspflichtig bestellen”), the Customer accepts the sales offer. The Vendor shall confirm the conclusion of the contract by e-mail (contract confirmation).
(5) The content of a contract concluded is stored by Etsy in the Vendor’s Etsy user account, which is not accessible to the Customer. In case the Customer does not place his order as “Guest” but has logged into his Etsy user account before, Etsy also stores the Contract text in the Customer’s Etsy user account, accessible in section “Purchases and Reviews” (“Einkäufe und Bewertungen”) in the “You” (“Du”) menu. In any case, Etsy shall send an e-mail with the content of the contract to the Customer. Beyond that, the Vendor neither saves the content of the contract nor does he provide access to it outside the Etsy platform.
(6) The Vendor shall inform the Customer by e-mail of any impediments preventing the delivery from being made, or of any other circumstances that might prevent contractual performance.
Section 3 – Prices, payment and delivery
(1) All product prices are total prices plus shipping costs. VAT will not be shown on invoices (§ 19 UStG).
(2) The shipping costs are listed in the respective product description under “Shipping & Returns” (“Versand & Rückgaben”)
(3) The Customer can pay by credit card (VISA, MasterCard, American Express). In the Cart section, additional means of payment may be available, such as PayPal or Klarna (“Sofort.”).
(4) Customer payments may be received by Etsy Ireland UC or by Etsy Payments Ireland Limited, both residing at 66/67 Great Strand Street, Dublin 1, Ireland, or, if payment is made in US$ oder CAN$, by Etsy Inc., 117 Adams Street, Brooklyn, NY, USA, (“Etsy” for short) on behalf of the Vendor. Etsy shall forward the amount paid to the Vendor.
(5) The Vendor reserves ownership of the delivered goods until the Customer has paid their purchase price in full.
(6) Where a delivery cannot be made because the Customer has provided a wrong or incomplete shipping address, an attempt to once again deliver the goods shall be made only if the Customer accepts to bear the direct costs of re-shipping the goods.
(7) Where deliveries are made to countries outside the European Union, customs or acquisition tax for imported goods may have to be paid by the Customer to the customs authorities upon receipt of the shipment. These duties will accrue in addition to the purchase price and the shipping costs; the Vendor has no means of influencing them.
Section 4 – Right of withdrawal for consumers
(1) A Customer purchasing as consumer is entitled to a right of withdrawal in accordance with the statutory pre-requisites.
(2) A consumer means every natural person who enters into a legal transaction for a purpose that is mainly outside his commercial or self-employed professional activity.
(3) The pre-requisites and legal consequences of the German stipulations as to consumers‘ rights of withdrawal shall apply to consumers having their permanent residence outside of Germany also in those cases in which the consumer’s national law does not provide for a right of withdrawal or provides for a shorter withdrawal period or for stricter requirements as to form.
Section 5 – Warranty
(1) Warranty claims shall be governed by the statutory regulations, unless otherwise provided for in the following paragraphs.
(2) If the Customer ist a consumer, the period of limitation regarding warranty claims for the second-hand goods offered can be shortened to one year if and to the extent that the consumer, before giving his consent to the contract, was specifically informed of the shortening of the limitation period and the shortening of the limitation period was expressly and separately agreed on in the contract.
(3) If the Customer ist not a consumer, the parties hereby agree that the period of limitation regarding warranty claims for the second-hand goods offered shall be shortened to one year.
(4) However, a shortened period shall neither apply to claims based on injury to life, body or health nor to claims for other damages arising from a grossly negligent or intentional breach of duty by the Vendor, by a legal representative of the Vendor or by a person used to perform an obligation of the Vendor.
Section 6 – Out-of-court Dispute Resolution
(1) For settling consumer disputes out-of-court, the European Union offers a platform for online dispute resolution (“ODR platform“) at ec.europa.eu/consumers/odr.
(2) We are neither obliged nor willing to participate in consumer dispute resolution proceedings.
Section 7 – Final provisions
(1) The laws of the Federal Republic of Germany shall apply, to the exclusion of the United Nations Convention on the International Sale of Goods (UNCISG). However, German law shall not apply to transactions with consumers having their permanent residence abroad to the extent the national laws applicable to those consumers set out provisions that cannot be contracted out to the detriment of the consumers.
(2) Should individual provisions of the present General Terms and Conditions prove to be invalid or impossible to implement, this shall not affect the validity of the remaining provisions.

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Gaby Lehnert, Speckfeld 23, 33824 Werther, phone 05203 2941928, e-mail gabylehnert@web.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions from the right of withdrawal
The right of withdrawal shall not exist for contracts regarding the delivery of merchandise that is not prefabricated and is made according to the consumer’s individual choice and specifications, or of merchandise that obviously is tailored to meet personal customer requirements.

Darüber hinaus speichert der Anbieter den Vertragstext nicht selbst und macht ihn außerhalb des Etsy-Portals auch nicht zugänglich.
(6) Bei Lieferhindernissen oder anderen Umständen, die der Vertragserfüllung entgegenstehen würden, informiert der Anbieter den Besteller per E-Mail.
§ 3 – Preise, Bezahlung und Lieferung
(1) Alle Warenpreise verstehen sich als Gesamtpreise zzgl. Versandkosten. Umsatzsteuer wird nicht ausgewiesen (§ 19 UStG).
(2) Die Versandkosten sind bei der jeweiligen Warenbeschreibung im Abschnitt „Versand & Rückgaben“ aufgeführt.
(3) Der Besteller kann per Kreditkarte zahlen (VISA, MasterCard, American Express). Im Warenkorb können daneben weitere Bezahlmethoden zur Verfügung stehen, z.B. PayPal oder Klarna („Sofort.“).
(4) Zahlungen des Bestellers können im Auftrag des Anbieters von Etsy Ireland UC oder von Etsy Payments Ireland Limited, beide ansässig 66/67 Great Strand Street, Dublin 1, Irland, bzw., bei Zahlung in US-Dollar oder Kanadischen Dollar, von Etsy Inc., 117 Adams Street, Brooklyn, NY, USA, (im Folgenden kurz „Etsy“) entgegengenommen werden. Etsy leitet in diesem Fall den gezahlten Betrag an den Anbieter weiter.
(5) Der Anbieter behält sich das Eigentum an der gelieferten Ware vor, bis der Besteller deren Kaufpreis vollständig bezahlt hat.
(6) Wenn eine Lieferung fehlschlägt, weil der Besteller die Lieferadresse falsch oder unvollständig angegeben hat, erfolgt ein erneuter Zustellversuch nur, wenn der Besteller die unmittelbaren Kosten des erneuten Versands übernimmt.
(7) Bei Lieferungen in Länder außerhalb der Europäischen Union können Zoll und Einfuhrumsatzsteuer anfallen, die vom Besteller beim Empfang der Sendung an die Zollbehörde zu entrichten sind. Diese Abgaben fallen zusätzlich zu Kaufpreis und Versandkosten an und sind vom Anbieter nicht zu beeinflussen.
§ 4 – Widerrufsrecht
(1) Einem Besteller, der als Verbraucher kauft, steht ein Widerrufsrecht gemäß den gesetzlichen Bedingungen zu.
(2) Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
(3) Einem Verbraucher mit ständigem Aufenthalt außerhalb Deutschlands räumt der Anbieter ein Widerrufsrecht gemäß den obigen Absätzen auch dann ein, wenn das nationale Recht des Verbrauchers kein Widerrufsrecht vorsieht oder den Widerruf an eine kürzere Frist oder an eine strengere Form knüpft als hier geregelt.
§ 5 – Gewährleistung (Mängelhaftung)
(1) Es bestehen Gewährleistungsansprüche des Bestellers (auch Mängelhaftungsrechte genannt) gemäß den gesetzlichen Vorschriften, soweit sich aus den folgenden Absätzen nichts anderes ergibt.
(2) Ist der Besteller Verbraucher, so kann die Verjährungsfrist für Gewährleistungsansprüche für die angebotenen Gebrauchtwaren auf ein Jahr verkürzt sein, wenn und soweit der Verbraucher vor der Abgabe seiner Vertragserklärung von der Verkürzung der Verjährungsfrist eigens in Kenntnis gesetzt wurde und die Verkürzung der Verjährungsfrist im Vertrag ausdrücklich und gesondert vereinbart wurde.
(3) Ist der Besteller kein Verbraucher, so vereinbaren die Parteien hiermit für die angebotenen Gebrauchtwaren eine auf ein Jahr verkürzte Verjährungsfrist für Gewährleistungsansprüche.
(4) Eine verkürzte Verjährungsfrist gilt jedoch in keinem Falle für Ansprüche aufgrund einer Verletzung des Lebens, des Körpers oder der Gesundheit und auch nicht für Ansprüche wegen sonstiger Schäden, die auf einer grob fahrlässigen oder vorsätzlichen Pflichtverletzung des Anbieters, seiner gesetzlichen Vertreter oder seiner Erfüllungsgehilfen beruhen.
§ 6 – Außergerichtliche Streitbeilegung
(1) Zur außergerichtlichen Beilegung von verbraucherrechtlichen Streitigkeiten stellt die Europäische Union eine Online-Plattform („OS-Plattform”) zur Verfügung unter der Adresse ec.europa.eu/consumers/odr.
(2) Wir sind weder verpflichtet noch bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
§ 7 – Schlussbestimmungen
(1) Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Gegenüber Verbrauchern mit ständigem Aufenthalt im Ausland findet das deutsche Recht jedoch keine Anwendung, soweit das nationale Recht des Verbrauchers Regelungen enthält, von denen zu Lasten des Verbrauchers nicht durch Vertrag abgewichen werden kann.
(2) Sollten sich einzelne Bestimmungen dieser allgemeinen Geschäftsbedingungen als unwirksam oder undurchführbar erweisen, so berührt dies nicht die Wirksamkeit der übrigen Bestimmungen.

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat.
Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Gaby Lehnert, Speckfeld 23, 33824 Werther, Telefon 05203 2941928, E-Mail gabylehnert@web.de) mittels einer eindeutigen Erklärung (z.B. ein mit der Post versandter Brief, Telefax oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Sie tragen die unmittelbaren Kosten der Rücksendung der Waren.
Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.
Ausnahmen vom Widerrufsrecht

Part I - General Terms and Conditions
Section 1 – Vendor, inclusion by reference of the General Terms and Conditions
(1) The Vendor and contracting party for the goods presented in the Etsy Shop „wiesengruenS“ is Gaby Lehnert, Speckfeld 23, 33824 Werther, phone 05203 2941928, e-mail gabylehnert@web.de (referred to hereinbelow as the “Vendor” for short).
(2) The present General Terms and Conditions are a component part of any contractual agreement made between the Vendor and the respective Customer. The Vendor hereby objects to any terms and conditions that the Customer may have established and that contradict the present General Terms and Conditions.
Section 2 – Goods offered and conclusion of contract
(1) The Vendor is offering the goods presented in the Etsy Shop “wiesengruenS” for sale to other Etsy users. The colors of the goods shown on the website may vary slightly depending on the internet browser and monitor settings used by the Customer; these variations are technically unavoidable.
(2) Selection of goods, conclusion of contract and implementation of the agreement shall all take place in German.
(3) The Customer shall select the goods desired by placing it in his “Cart” (“Warenkorb”). When the cart contains all goods desired, the Customer proceeds to the checkout by clicking on “Proceed to Checkout” (“Zur Kasse gehen”). The page titled “Please confirm and submit your order” shall display a summary, so that the Customer can check for any incorrect input. On this page, the Customer can place his order with the Vendor by clicking on the button “Buy” (“Zahlungspflichtig bestellen”). Until the order is transmitted to the Vendor, the Customer may go back one or multiple steps in the browser to modify the data input or to completely discontinue the order.
(4) The Vendor is making a binding sales offer for the goods presented in his shop. By transmitting the order using the button “Buy” (“Zahlungspflichtig bestellen”), the Customer accepts the sales offer. The Vendor shall confirm the conclusion of the contract by e-mail (contract confirmation).
(5) The content of a contract concluded is stored by Etsy in the Vendor’s Etsy user account, which is not accessible to the Customer. In case the Customer does not place his order as “Guest” but has logged into his Etsy user account before, Etsy also stores the Contract text in the Customer’s Etsy user account, accessible in section “Purchases and Reviews” (“Einkäufe und Bewertungen”) in the “You” (“Du”) menu. In any case, Etsy shall send an e-mail with the content of the contract to the Customer. Beyond that, the Vendor neither saves the content of the contract nor does he provide access to it outside the Etsy platform.
(6) The Vendor shall inform the Customer by e-mail of any impediments preventing the delivery from being made, or of any other circumstances that might prevent contractual performance.
Section 3 – Prices, payment and delivery
(1) All product prices are total prices plus shipping costs. VAT will not be shown on invoices (§ 19 UStG).
(2) The shipping costs are listed in the respective product description under “Shipping & Returns” (“Versand & Rückgaben”)
(3) The Customer can pay by credit card (VISA, MasterCard, American Express). In the Cart section, additional means of payment may be available, such as PayPal or Klarna (“Sofort.”).
(4) Customer payments may be received by Etsy Ireland UC or by Etsy Payments Ireland Limited, both residing at 66/67 Great Strand Street, Dublin 1, Ireland, or, if payment is made in US$ oder CAN$, by Etsy Inc., 117 Adams Street, Brooklyn, NY, USA, (“Etsy” for short) on behalf of the Vendor. Etsy shall forward the amount paid to the Vendor.
(5) The Vendor reserves ownership of the delivered goods until the Customer has paid their purchase price in full.
(6) Where a delivery cannot be made because the Customer has provided a wrong or incomplete shipping address, an attempt to once again deliver the goods shall be made only if the Customer accepts to bear the direct costs of re-shipping the goods.
(7) Where deliveries are made to countries outside the European Union, customs or acquisition tax for imported goods may have to be paid by the Customer to the customs authorities upon receipt of the shipment. These duties will accrue in addition to the purchase price and the shipping costs; the Vendor has no means of influencing them.
Section 4 – Right of withdrawal for consumers
(1) A Customer purchasing as consumer is entitled to a right of withdrawal in accordance with the statutory pre-requisites.
(2) A consumer means every natural person who enters into a legal transaction for a purpose that is mainly outside his commercial or self-employed professional activity.
(3) The pre-requisites and legal consequences of the German stipulations as to consumers' rights of withdrawal shall apply to consumers having their permanent residence outside of Germany also in those cases in which the consumer's national law does not provide for a right of withdrawal or provides for a shorter withdrawal period or for stricter requirements as to form.
Section 5 – Warranty
(1) Warranty claims shall be governed by the statutory regulations, unless otherwise provided for in the following paragraphs.
(2) If the Customer ist a consumer, the period of limitation regarding warranty claims for the second-hand goods offered can be shortened to one year if and to the extent that the consumer, before giving his consent to the contract, was specifically informed of the shortening of the limitation period and the shortening of the limitation period was expressly and separately agreed on in the contract.
(3) If the Customer ist not a consumer, the parties hereby agree that the period of limitation regarding warranty claims for the second-hand goods offered shall be shortened to one year.
(4) However, a shortened period shall neither apply to claims based on injury to life, body or health nor to claims for other damages arising from a grossly negligent or intentional breach of duty by the Vendor, by a legal representative of the Vendor or by a person used to perform an obligation of the Vendor.
Section 6 – Out-of-court Dispute Resolution
(1) For settling consumer disputes out-of-court, the European Union offers a platform for online dispute resolution (“ODR platform“) at ec.europa.eu/consumers/odr.
(2) We are neither obliged nor willing to participate in consumer dispute resolution proceedings.
Section 7 – Final provisions
(1) The laws of the Federal Republic of Germany shall apply, to the exclusion of the United Nations Convention on the International Sale of Goods (UNCISG). However, German law shall not apply to transactions with consumers having their permanent residence abroad to the extent the national laws applicable to those consumers set out provisions that cannot be contracted out to the detriment of the consumers.
(2) Should individual provisions of the present General Terms and Conditions prove to be invalid or impossible to implement, this shall not affect the validity of the remaining provisions.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions from the right of withdrawal
The right of withdrawal shall not exist for contracts regarding the delivery of merchandise that is not prefabricated and is made according to the consumer's individual choice and specifications, or of merchandise that obviously is tailored to meet personal customer requirements.
